Abstract

This study examines the judicial reasoning in Decision Number 895/Pdt.G/2021/PA.Sdn concerning the division of marital property after divorce, which deviates from the normative provision of equal distribution as stipulated in Article 97 of the Compilation of Islamic Law. The research aims to analyze the legal considerations of judges and assess their conformity with the principles of maqaṣid al-shari‘ah. This study employs a qualitative method with a normative juridical case approach, using maqaṣid al-shari‘ah theory, particularly as formulated by al-Shatibi, as the analytical framework. The findings reveal that the judges prioritized substantive justice by considering the actual economic contributions of the parties, resulting in a proportional distribution of 3⁄4 to the wife and 1⁄4 to the husband. This decision reflects the protection of wealth (ḥifẓ al-mal) and extends to safeguarding welfare aspects related to life and lineage (ḥifẓ al-nasl). The study concludes that the decision represents a contextual and progressive application of Islamic family law, balancing legal certainty with justice and public interest. It is recommended that future judicial practices explicitly incorporate maqaṣid-based reasoning to strengthen the legitimacy and consistency of decisions in similar cases.
