Abstract
This study discusses the analysis of the gap between regulations and practices in fulfilling children's rights in the context of divorce. This study aims to specifically identify where there are gaps between regulations and practices that occur in the field in efforts to fulfill children's rights after divorce. In addition, this study also aims to determine the impact or influence of the gap on the welfare and rights of children after divorce. This includes various risks faced by children who are victims of divorce, both in terms of physical, mental, and social welfare. The research method used is a qualitative approach with data collection through semi-structured interviews and documentation. The results of the study indicate that the main problems include parents who are not committed, lack of family support, quality time, negative stigma from society, children are not given proper education and the busyness of parents.
Factors causing the gap include economic conditions, responsibility, communication, intervention from other parties, double burdens borne and low levels of parental education. The implications of the gap between regulations and practices affect the condition of children. The impacts include free association, bad behavior, lack of affection, distance between parents and children and not having a role model in their lives which can ultimately hinder children's growth and development.
